Verification of Identity
Lawyers are responsible for verifying the identity of their clients and must be satisfied that the documents provided are current and authentic.The person being identified must produce current and original proof of their identity as listed below.
Standard Verification of Identity
The purpose of carrying out verification of identity (VOI) is to reduce the risk of identity fraud and the registration of fraudulent land transactions.
VOI of clients is considered to be part of the due diligence process and follows a framework set out by the Registrar-General for legal professionals.
A verification of identity should be completed for each client and will include attending a face-to-face meeting and providing original documents as proof of identity.
International Verification of Identity
Australian citizens and residents who are overseas and are having their identity verified must have their identity verified at an Australian Consular Office.
Verification Documents
The person being identified will need to provide original and current proof of their identity from the categories below.
Please note:
- An expired Australian passport which has not been cancelled and was current within the preceding two years, can be used as proof of identity to complete VOI.
- Certified copies of the documents cannot be accepted to satisfy category 1 requirements.
